The NBA legend Testifies He Felt No Fear of the Racing Body in Legal Battle

Michael Jeffrey Jordan, introducing himself formally in a Charlotte court on Friday, admitted that his drive to win and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over perceived violations of competition laws.

Financial Stakes and a Will to Win

Jordan shared operational insights of his 23XI team, saying he invested $40m of his own funds into the Cup Series operation co-founded with partner Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan said during testimony. “I was a new person, I wasn’t afraid. I believed I could take on Nascar in its entirety. I felt as far as the sport it needed to be looked at through a new lens.”

Central Issue: Charter Agreements and Renewal Demands

At issue is the end of a 2016 deal where Nascar granted each team a franchise. This system mirrors other major leagues with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for about sixty minutes and left the court to pandemonium, with onlookers and reporters clamoring for a view or a photo of the sports legend.

Leading the Legal Charge

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to change a business model Jordan contended is breaking the law to maintain excessive control.

At issue for Jordan and Heather Gibbs, who testified before Jordan, are details from last September. She recounted a hectic and tense period where the racing circuit told teams they had to sign a charter agreement extension. This agreement spanned over a hundred pages detailing team compensation and a guaranteed entry in every race.

Choosing Litigation

Jordan explained that his team and its ally concluded their sole viable path was to refuse a signature that extensive document and litigate the matter. All other teams signed the agreement.

The team owners approached Nascar about potential amendments or negotiations. Nascar refused to engage, according to his testimony.

The Bottom Line: Victory

But in the end, the resistance against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Winning.

“Hamlin persuaded me getting a third driver boosted our odds of winning,” he testified, sharing that he purchased another franchise last year for $28m amid the legal dispute. “So I dove in.”

Heather Gibbs’ Testimony

Heather Gibbs detailed her push for indefinite franchises, which she said a written letter to Nascar. She testified the pressure of the signature deadline didn’t sit well.

She said, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.

“Please don’t force this on us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. She said France replied, “Whether I have 20 charters, that’s what I have. If I have 30, that’s the number.”
