US Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without lawful basis.
"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration detention.
In her order, the court pointed out that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

The legal challenge center on conflicting assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in the state of Tennessee.
Conditions of Release
The court, who was overseeing his petition to removal in a federal court, determined that he must now comply with the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
